7-101.11 Identifying Information, Prominence-Original Containers (Pf) 7-201.11 Separation-Storage (P) Observed a spray bottle with no labels containing a purple liquid being stored on the shelf next to an open container of tostada. PIC confirmed the bottle contains Fabuloso cleaning product. PIC confirmed the tostada are for public consumption and being stored in the containers for easy access in case guests want extra chips. The container was stored on a shelf under the service station with other cleaning/utility products. Explained to PIC all cleaning containers must be labeled and not stored in direct contact with food items. PIC voluntarily discarded the tostada and labeled the bottle.

2-102.11(C)(2),(3) and (17) Demonstration (Pf) 2-103.11(M) Person in Charge-Duties (Pf) The Person in Charge (PIC) failed to demonstrate adequate knowledge and control of food safety practices related to the cooling and cold holding of Time/Temperature Control for Safety (TCS) foods, as required by the 2017 FDA Food Code. The facility has been repeatedly instructed not to use the shared walk-in refrigerator for cooling TCS foods because the refrigerator is also used by the adjacent gas station. Frequent access by customers and gas station employees for purchasing and restocking results in repeated door openings and prevents the unit from maintaining conditions conducive to proper cooling. During the inspection, TCS foods were observed being held in the walk-in refrigerator, and foods removed from the unit were measured at approximately 44°F–46°F. The PIC had previously been informed of the improper cooling practice and had developed a corrective plan during the prior inspection; however, the plan was not implemented. The continued use of the shared walk-in refrigerator for cooling, combined with inadequate monitoring and improper cooling methods, demonstrates that the PIC has not maintained effective control over the identified food safety risk factors. These conditions demonstrate a failure by the PIC to demonstrate knowledge of the relationship between time/temperature control and foodborne illness prevention, including the required temperatures and methods for refrigerated storage and cooling of TCS foods.
