3-501.16 (A) Except during preparation, cooking, or cooling, or when time is used as the public health control as specified under §3-501.19, and except as specified under (B) and in (C ) of this section, TIME/TEMPERATURE CONTROL FOR SAFETY FOOD shall be maintained: (2) At 5ºC (41ºF) or less. Observed gallons of milk that were being stored on the bottom shelving of the dairy refrigeration unit that were not maintaining cold-holding temperatures (41F degrees or below). The temperature of the milk according to the Infrared Thermometer was 43F degrees. A min/max thermometer was placed on the shelving next to the gallons of milk to provide an ambient temperature. The ambient temperature was not giving a reading lower than 43F degrees. However, when the min/max thermometer was placed on the top shelf that was closest to the condenser unit, the ambient temperature was 36F degrees. The top shelf contained ultra-pasteurized that were shelf-stable.
